Terms of Service

These Terms of Service govern your access to and use of TomoTab, including our websites, applications, public and private profile pages, boards, tablets, cards, features, media uploads, paid plans, and related services. By using TomoTab, you agree to these Terms. If you do not agree, do not use the Service.

1. Who We Are

The Service is provided by TomoTab, referred to in these Terms as "TomoTab," "we," "us," or "our." If you have questions about these Terms, contact us at [email protected].

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to create an account or use the Service.

By using the Service, you represent and warrant that you meet this requirement and are not prohibited from using the Service under applicable law. We may suspend, restrict, or terminate accounts if we reasonably believe a user does not meet these eligibility requirements.

3. Accounts and Registration

You must:

  • provide accurate and complete registration information;
  • keep your account information up to date;
  • maintain the security of your login credentials and devices;
  • promptly notify us of unauthorized access to your account.

You are responsible for activity that occurs under your account, whether or not authorized by you, unless applicable law provides otherwise. We may refuse registration, suspend access, or require additional verification where reasonably necessary to protect users, the Service, or our business.

4. Login Methods and Linked Identity

You may access the Service using email-based login methods, social login providers, or other supported authentication methods.

If you connect or use a third-party login provider, you authorize us to receive certain account information from that provider, such as your name, email address, and provider-specific account identifier, subject to that provider's settings and policies.

You are responsible for using the correct login account. We may create, link, restrict, or refuse accounts in accordance with our authentication, account integrity, and abuse-prevention rules.

5. The Service

TomoTab lets users create, organize, publish, manage, and share content collections, profile and persona pages, tablets, cards, rich media, links, embeds, and related experiences. Features and limits may vary by plan, account status, geography, or product status.

We may add, modify, suspend, or remove features at any time. We may also impose usage limits or restrictions where reasonably necessary for operational, security, legal, or product reasons.

6. Your Content

You retain ownership of the content you submit, upload, post, link, embed, or otherwise make available through the Service, referred to as "Your Content."

You grant TomoTab a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, adapt, publish, transmit, display, distribute, and otherwise use Your Content as necessary to:

  • operate, maintain, and improve the Service;
  • display Your Content to you and others as directed by your settings;
  • provide public pages, followers, subscriptions, and content-sharing functionality;
  • generate previews, metadata, thumbnails, transcodes, or similar derived assets;
  • support moderation, security, abuse prevention, backup, and legal compliance.

This license ends when Your Content is deleted from the Service, except to the extent limited retention is required for backups, legal compliance, fraud prevention, dispute resolution, enforcement, or ordinary-course derivative caches and system copies.

You are solely responsible for Your Content and for ensuring that you have all rights, licenses, permissions, and consents needed to post, publish, link, embed, distribute, or otherwise use it through the Service.

7. Public Content, Embeds, and Third-Party Services

The Service may allow you to publish content publicly and to include links, previews, or embeds from third-party services. You acknowledge that:

  • public content may be viewable by other users and the public, depending on your settings;
  • third-party content, embeds, links, and media are governed by the terms and privacy policies of those third parties;
  • third-party services may change, fail, restrict access, rate-limit, remove content, or alter compatibility at any time;
  • TomoTab is not responsible for third-party content, services, availability, accuracy, or policies.

We may remove, disable, or limit third-party embeds or integrations if needed for legal, operational, product, safety, or technical reasons.

8. Acceptable Use

You may not, and may not assist others to:

  • violate any law or regulation;
  • infringe, misappropriate, or violate the rights of others;
  • upload, post, link, or distribute unlawful, fraudulent, deceptive, defamatory, harassing, abusive, hateful, or obscene content;
  • impersonate another person or misrepresent your affiliation or identity;
  • use the Service to distribute malware, malicious code, phishing content, or abusive automation;
  • scrape, crawl, harvest, or access the Service in an unauthorized manner;
  • overload, disrupt, interfere with, or degrade the Service or its infrastructure;
  • attempt to bypass limits, entitlements, access controls, or security mechanisms;
  • reverse engineer, decompile, or attempt to derive source code from the Service except to the extent prohibited by law;
  • use the Service to store or distribute content that you do not have rights to use;
  • engage in fraudulent subscription, payment, traffic, engagement, or account behavior.

We may investigate violations and take action including suspension, content removal, access restriction, account termination, referral to law enforcement, or other remedies.

9. Paid Plans, Billing, and Auto-Renewal

TomoTab may offer free and paid plans. Plan features, limits, and pricing may change over time.

If you purchase a paid plan, you authorize us and our payment processors to charge the applicable fees, taxes, and any recurring subscription charges using your selected payment method. Unless otherwise stated at purchase, paid subscriptions automatically renew at the end of each billing period until canceled.

You may cancel your subscription at any time. Unless required by law or stated otherwise at purchase, cancellation takes effect at the end of the current billing period, and we do not provide prorated refunds for unused time.

We may change pricing, plan terms, or features. Where required by law, we will provide notice before a renewal at a changed price takes effect.

If your subscription lapses, payment fails, or your plan changes, your access to paid features may change immediately or at the end of the current billing period, depending on the product flow. We may limit, lock, reconcile, reset, unpublish, or otherwise adjust plan-restricted features or states so your account matches your current entitlement level.

Refunds, if any, are provided only if required by law or expressly stated at the time of purchase.

10. Entitlements, Limits, and Feature Access

Certain features, publishing rights, appearance controls, usage caps, storage allowances, follower limits, or similar capabilities may depend on your current plan, subscription status, beta status, account standing, or other eligibility criteria.

We may enforce those limits through the Service interface, backend systems, automated reconciliation, access controls, or other mechanisms. You may not circumvent or attempt to circumvent those limits.

11. Suspension and Termination

We may suspend, restrict, disable, or terminate access to all or part of the Service if:

  • you violate these Terms;
  • we reasonably suspect abuse, fraud, or security threats;
  • your use creates legal or operational risk;
  • we are required to do so by law;
  • your payment fails or your account is not in good standing;
  • continued service is not commercially or technically practical.

You may stop using the Service at any time. Termination does not limit any rights or remedies that accrued before termination.

12. Deletion and Retention

You may request deletion of your account in accordance with our deletion flow and policies. Deletion may not be immediate. Some data may be retained for a limited period to complete deletion workflows, maintain backups, comply with law, prevent fraud and abuse, resolve disputes, enforce these Terms, or maintain limited operational or security records.

13. Intellectual Property

The Service, including our software, design, branding, logos, trademarks, trade dress, text, graphics, and underlying technology, is owned by TomoTab or its licensors and is protected by intellectual property and other laws.

Except as expressly permitted by these Terms, you may not use, copy, modify, distribute, sell, license, or exploit any part of the Service without our prior written permission.

14. Feedback

If you provide feedback, suggestions, or ideas regarding the Service, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use them without restriction or compensation to you.

15. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOMOTAB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We do not guarantee that the Service will be uninterrupted, secure, error-free, or available at all times, or that content or data will never be lost, delayed, or corrupted.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOMOTAB AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

17. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless TomoTab and its affiliates, officers, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to Your Content, your use of the Service, your violation of these Terms, or your violation of any law or rights of another person or entity.

18. Governing Law and Disputes

These Terms and any dispute arising out of or relating to them or the Service are governed by applicable law, without regard to conflict-of-law principles, except where local consumer law requires otherwise.

Any dispute resolution terms required for your jurisdiction or purchase flow may apply in addition to these Terms.

19. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will provide notice as required by law or through the Service.

By continuing to use the Service after updated Terms become effective, you agree to the revised Terms.

20. Miscellaneous

  • These Terms constitute the entire agreement between you and TomoTab regarding the Service, except where additional terms apply.
  • If any provision of these Terms is held unenforceable, the remaining provisions remain in effect.
  • Our failure to enforce any provision is not a waiver of our rights.
  • You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
